Common defenses

No 'willful or wanton' disregard

§316.192 requires proof of WILLFUL or WANTON disregard for safety — not just negligence. A 3d DCA Nov. 8, 2023 unnamed reckless-driving reversal found insufficient evidence for willful/wanton intent when the defendant's conduct was 'merely negligent' driving. The same standard applies to officer observations of erratic driving — they must rise to willful/wanton, not just careless.

Bunkley reasonable-doubt argument

Florida courts apply the Bunkley reasonable-doubt standard to mens rea elements like 'willful or wanton.' When the state's evidence is consistent with both reckless AND merely careless driving (§316.1925), the lesser-included careless-driving instruction must be given — and the jury can choose the lesser charge.
